Target Group / Level

Adult Social Care staff within the London Borough of Sutton and Private, Independent and voluntary (PVI)  sector supporting Sutton residents in residential care, nursing care, home care, Personal Assistants, and supported living.   

Staff Groups A, B, C, D, and E as per the Bournemouth University National Mental Capacity Act Competency Framework.

Level 2 staff and above (ref: NHS Intercollegiate document 2018 - Adult Safeguarding: Roles and Competencies For Healthcare Staff): All practitioners who have regular contact with patients, their families or carers, or the public.

Note: Participants must have attended Safeguarding Awareness and Mental Capacity Act training prior to attending this course.

Course Overview

This full day training session aims to give participants an overall understanding of how the Deprivation of Liberty Safeguards (“DoLS”) apply to their day-to-day work settings.

Learning Outcomes

Following the completion of this course, participants will have:

• Gained understanding of a range of judgements that have been made by the Court of Protection in relation to DoLS, in particular the “Neary” and “Bournewood” cases
• Gained knowledge how the Supreme Court rulings of March 2014 in the “Cheshire West” and “MIG and MEG” cases have changed our understanding of what constitutes a “deprivation of liberty”
• Improved their understanding of how DoLS protects the Human Rights of the service user, as well as the professionalism and integrity of the worker
• Gained the knowledge and the confidence to explain the difference between restriction of liberty and deprivation of liberty
• Gained knowledge on what are the six Qualifying Requirements of a DoLS application, and the skill to distinguish between an Urgent Authorisation and a Standard Authorisation
• Gained understanding of the functions of the Independent Mental Capacity Advocate, Best Interest Assessor, Supervisory Body and the person’s Representative in the DoLS process
• Gained the skill to complete the relevant paperwork to make an application to the local authority for authorisation to deprive a person of their liberty (applicable to residents in care homes and patients in hospital settings)
• Gained the skill to complete the relevant paperwork to make an application directly to the Court of Protection for authorisation to deprive a person of their liberty (applicable to people who live in supported living, Shared Lives, sheltered housing and their own homes)

If you already have a reasonably good understanding of the Mental Capacity Act and of DoLS do not book on to this course, please choose the half day DoLS refresher session instead.
